Temecula ASR Hip Replacement Failure Lawsuits

Despite requiring FDA approval before putting a product on the market, defective medical devices are responsible for many thousands of serious medical injuries every year. A recent problem with DePuy ASR hip replacement orthopedic implants has led the manufacturer to issue a voluntary recall. The defective product under recall specifically relates to a hip ball implant manufactured after July, 2003. If you are the recipient of a hip surgery implant since 2003, talk to your doctor to determine whether your implant was manufactured by DePuy Orthopedics, a division of Johnson & Johnson. If so, the manufacturer has a specific procedure for submitting a claim for 'reasonable costs' associated with having the implant removed and replaced.

Originally, the entire ASR hip replacement implant was approved by the FDA. However, DePuy introduced a third component — a 'cup' cover — which never received full FDA approval.*

What Goes Wrong

The DePuy website** announcing the recall explains the procedures for filing a claim for reasonable expenses associated with the recall. The implant is composed of three components, including the femoral stem (inserted inside the femur), and the femoral head (ball), which connects to the stem. The assembly is then fit inside the acetabular cap, which body tissue attaches itself to. Because of the way the device is assembled, frequent problems can develop in the areas where there is metal-on-metal contact between the components.

The causes of the injury include:

  • Loosening of the device from the bone, causing the device to move out of position
  • Bone fracture surrounding the device
  • Dislocation and misalignment of the component parts

The symptoms of an injury from the defective implant include:

  • Persistent pain
  • Immobility, stiffness
  • Swelling in surrounding area
  • Difficulty walking

The injuries can result in a chronic condition that inflicts ongoing pain and requires years of medical treatment and physical therapy. If you suffer any kind of physical harm or financial damages associated with the replacement surgery because of this recall, you are entitled to seek damages in a lawsuit.
