The Financial Implications of Divorce
If you have decided to get a divorce, you probably have spent some time worrying about how dividing one household into two will affect you financially. Naturally, you'd like to know in advance exactly how much financial support you might expect to pay or receive. Unfortunately, there is no certain answer.
At Gibbs & Fuerst, LLP, we understand the financial anxiety that child and spousal support create and can help you resolve these issues fairly and reasonably. Our family law practice is limited to Riverside County where we know the local judges and opposing counsel — an asset that can be tremendously beneficial whenever financial disputes cannot be resolved through negotiation or the mediation process.
California Child Support Guidelines
California uses a statutory formula to determine how much child support one parent should pay to the other. Specific factors that are taken into account in the formula include the net incomes of both parents, the number of children, the cost of health insurance paid by the parents, and the amount of time the children spend with each parent. While judges do have some discretion to deviate from the guideline amounts, we can usually give clients a fairly accurate assessment of child support amounts early on.
Spousal Support
Spousal support, also known as alimony, is not a part of every divorce. Cases tend to be very fact-specific and outcomes hard to predict. Some of the various factors considered by courts in determining whether an order for spousal support is justified include the length of the marriage, the ages and health of both spouses, and the income and earning capacity of each spouse as well.
Our attorneys can explain what all the various factors are and how they might apply in your situation.
