Couple receives $1 million settlement in California accident

According to documents filed with the court, a San Juan Capistrano couple will receive $1 million in a settlement negotiated with a truck driver's estate and his employer. According to documents, the settlement resulted from a collision between the truck driver and a passenger vehicle on Jan. 12, 2012.

The truck driver, who died in the collision, reportedly drifted into the woman's lane on a highway near Buellton, colliding with the 2001 BMW 325i the woman was driving. The force of the collision caused the woman's vehicle to dangle precariously off a bridge from which she and her children were later rescued. The truck driver's truck apparently plummeted over the edge, where it caught fire upon hitting the ground below. The truck's driver apparently died as a result of his injuries.

Toxicology tests later reportedly showed the truck's driver was under the influence of methamphetamine and amphetamine at the time of the collision. The woman and her children received medical treatment as a result of their injuries.

When a car is involved in a truck accident, people are often seriously injured or killed due to the sheer size and weight of large trucks. When an accident occurs as a result of the truck driver's wrongful or negligent accidents, those who are injured may be able to recover damages for the injuries and losses they suffered by filing a personal injury lawsuit. In such a collision, both the semi-truck driver as well as his or her employer may be held liable for the driver's actions. Even in situations in which the at-fault truck driver dies, his or her estate may be held liable. Victims may be able to recover damages for medical expenses, counseling, pain and suffering, loss of companionship, lost income, property losses and, in some cases, punitive damages.
